In a shocking turn of events, ActionSA leader Herman Mashaba has raised serious doubts about South Africa's criminal justice system following the controversial release of a foreign national accused of raping a 12-year-old girl on a mere R1,000 bail. This startling decision has ignited a wave of anger across the nation, as Mashaba and many South Africans call for urgent reform.

Mashaba did not mince his words when addressing the issue. Reflecting on the case during an impassioned post on social media, he stated:

“This deliberate failure of our criminal justice system cannot be left unchallenged. We are tired,”

illustrating his frustration over a system that seems to let victims down.

The Disturbing Case

The accused, identified as Siddique Ammad, a 29-year-old Pakistani national, was granted bail by the Atteridgeville Court on January 6, 2025. His trial has been postponed to March 2, 2026. While the online uproar against his release is palpable, some have reported that the victim's family is surprisingly supportive of the situation.

“When I spoke to the family, they told me that they supported the charges being dropped against the accused, as the accused had promised to marry the child & support her,”

reported Shenaaz Wasiem from a local Women’s Group, adding another layer of complexity to this highly sensitive case.

Public Reaction

The public's response has flooded social media, with many echoing Mashaba's sentiments about the failures of the justice system:

@skutuphendu exclaimed:

“R1,000 for bail in a rape case of a minor. The NPA is embarrassing us.”

Others expressed similar frustration:

@Ms_Tcmathonsi lamented, “Our government is failing us.”
@TshepoThathane declared, “Injustice right in front of our eyes.”

Many citizens believe the current bail system is too lenient, especially for serious offenses, urging for stricter regulations in the face of escalating crime.

Mashaba's Ongoing Battle

This incident isn't the first time Mashaba has spoken out against issues surrounding foreign nationals and crime in South Africa. His history of challenging perceived injustices highlights a growing concern among citizens about the safety and efficacy of the current legal framework. The recent controversy surrounding the bail granted to Ammad has reignited discussions about the integrity of the justice system and the protection of vulnerable individuals in society.

As this case unfolds, it remains to be seen what changes may come in response to public outcry and if the justice system will rise to meet the expectations of its citizens.
