AmaZulu's Signing of Liam Bern Leads to Legal Tangle with Cape Town Spurs

Cape Town Spurs Demand Transfer Fee

AmaZulu recently acquired midfielder Liam Bern as a free agent, following a ruling from the PSL Dispute Resolution Chamber (DRC) that favored him. However, Cape Town Spurs assert their right to a transfer fee and have escalated the situation to the South African Football Association (SAFA) Appeals Board.

This development was anticipated, as Spurs had previously taken legal action against Kaizer Chiefs regarding the signings of former players Asanele Velebayi and Luke Baartman.

Why Spurs Are Blocking Liam Bern’s Move

Liam Bern has been in a prolonged contractual dispute with Spurs, who earlier inhibited his transfer to AmaZulu, arguing that he remained under contract and could not enter free agency.

Bern's legal team, supported by AmaZulu, contested this by referencing a PSL regulation that nullifies contracts when a club is relegated to the ABC Motsepe League. Spurs' relegation at the conclusion of the last season enabled Bern to claim free agency.

Precedent Set by Velebayi and Baartman

Bern’s situation mirrors that of his former teammates, Velebayi and Baartman, who also sought free agency after Spurs' relegation. Both secured victories at the DRC and signed with Chiefs, yet their eligibility to play remains unclear until Spurs’ appeal is resolved.

In the same vein, AmaZulu is unable to field Bern until the SAFA Appeals Board reaches a verdict.

SAFA Appeals Board Decision Will Be Final

The Appeals Board represents the conclusion of the legal proceedings. Upon issuance of their ruling, Cape Town Spurs will not have further appeal options.

If the ruling affirms AmaZulu's stance, Bern will be eligible to play immediately. Conversely, a favorable decision for Spurs may compel AmaZulu to pay a transfer fee or potentially forfeit the player.
