In a significant move for South Africa's legal landscape, President Cyril Ramaphosa has announced the appointment of Advocate Jan Lekgoa Mothibi as the new National Director of Public Prosecutions, effective from 1 February 2026. Mothibi steps into the role following Advocate Shamila Batohi, who faced scrutiny during her tenure, particularly for not securing any high-profile convictions.
Adv. Mothibi is currently the Head of the Special Investigating Unit (SIU) and has an extensive background, having started his career as a Public Prosecutor in Johannesburg and Soweto's Magistrates and Regional Courts.
The Selection Process
The rigorous selection process saw the interviewing of six candidates, all of whom were unable to meet the panel's high standards. Despite being unlisted for the position, Mothibi was ultimately chosen by President Ramaphosa, who made the decision in accordance with the South African Constitution after consulting an advisory panel led by the Minister of Justice and Constitutional Development, Mmamoloko Kubayi.

Adv. Andrea Johnson was one candidate who faced considerable scrutiny, gathering 208 objections and being questioned about references on her CV, particularly from suspended Ekurhuleni legal executive Kemi Behari. The selection panel noted the concerns but ultimately, none of the shortlisted candidates were deemed suitable, paving the way for Mothibi’s unexpected nomination.
