A Louisiana mother has filed a lawsuit in San Francisco against popular online games Fortnite and Roblox, alleging that prolonged exposure to these games has caused structural changes in her child's brain.
Descheca Jackson claims, in a lawsuit submitted to the US District Court for the Northern District of California, that her minor child, referred to as "MA," has experienced symptoms indicative of internet gaming disorder (IGD) since beginning to play at a young age. These symptoms include loss of impulse control, withdrawal, irritability, anxiety, and challenges in disengaging from gameplay. The lawsuit details that MA has struggled with addiction, social isolation, depression, and academic challenges leading to dismissal from school.
Research has indicated that IGD can significantly disrupt daily life, with disruptions noted in school, work, and personal relationships. It is suggested that one in ten adolescent boys may experience this disorder, with titles like Minecraft and Roblox frequently implicated.
Jackson asserts that MA's extensive gaming on Xbox consoles has fostered compulsive behaviors linked to reward systems that engage young, developing brains. She cites neuroimaging studies suggesting similar structural changes in the developing brain, particularly in the prefrontal cortex, which is crucial for decision-making and emotional regulation.
While the lawsuit acknowledges the awareness of potential risks associated with prolonged gaming, it argues that MA, being a minor, could not fully understand the terms and conditions of the games. The complaint contends that the contracts signed within the games are invalid due to the manipulation aimed at maximizing player engagement through various strategies.
Jackson states, "MA never agreed to be harmed or exposed to an addictive product," asserting that no legitimate contract was formed with the defendants. The lawsuit raises concerns about negligence, design defects, and seeks damages and injunctive relief on multiple counts.
